LANDMARK CONSTITUTIONAL COURT RULING

STATEMENT ISSUED BY ANNELIZÉ VAN WYK, MP

The UDM welcomes the Constitutional Court ruling regarding the matter of Ms Carmichele versus the Departments of Justice and Safety and Security. This is a landmark ruling and sets the stage for a dramatic embarrassment for the ANC government.

The first priority of a democratic government should always be the safety of its citizens. In a country with the highest rate of rape and sexual abuse in the world this becomes a direct indictment of the ANC government's inability to fulfil its most basic democratic responsibility.

It is true that SA has inherited many problems from the previous regime. That is exactly why the ANC, who purports to be the custodian of human rights in SA, should distinguish itself from the oppressors of old.

It is simply unacceptable that a citizen should have to go to court to force the ANC to acknowledge its constitutional responsibilities. It can also not be claimed by government that this case is an exception or resulted from administrative bungling at local level. Because the very Ministers of Justice and Safety and Security mocked the shocking rate of rape in this country in front of an international TV crew. It is after all the National Commissioner of Police who complained about unenforceable domestic violence laws earlier this week. It is high time that ANC government is held accountable for the rate of crime, especially against women, in this country.
