OPEN LETTER to Minister Moleketi

Dear Madam

It has come to our attention that the Director-General in the Department of Home Affairs, Rev Billy Masethla has worked in that capacity without a legal contract defining his rights and obligations in the position in which he is employed.

We are further informed that this unsatisfactory unlawful state of affairs has persisted for the entire duration of the contract he did not sign which covered the period during which he acted as Director-General.

Further, it has come to our attention that when a new contract was given to him to sign for an extended period, as a result of an intervention by the President, who insisted on his being retained as Director-General, he refused to sign and thereby continued to work as Director-General in contravention of the Public Service Act. and against the wishes of the Minister.

If this information is correct, this is blatant flouting of the Act and conventions of the Public Administration. It is therefore inconceivable that the President whose office is the embodiment of the Constitution and the laws that emanate from it, should be the one to condone the contravention of the Act by insisting on Rev Masethla’s retention in the post without signing a contract.

The salary paid to him to date amounts to unauthorised expenditure with regard to which parliament and its relevant structures and the taxpayers take a dim view.

In the interests of good and clean governance and transparency would you please investigate these allegations if they are not known to you and assure the public that this situation will be rectified as a matter of urgency.
