COURT OVERRULES AGE LIMIT FOR PRIVATE SCHOOLS statement by UDM Spokesperson for Education (16 January 2001)

Serious concerns are raised by the Pretoria High Court ruling which declared those restriction regulations, as published in the Government Gazette last year on private schools, as invalid and unconstitutional.

The implication of education regulations and possibly even legislation contravening the Constitution is an unbearable situation. The Minister of Education, Kader Asmal, is urged to act swiftly to ensure that the matter is clarified and that there are no other regulations that might follow the same
route.

The danger of publishing regulations, by Ministers, which have not been scrutinised in order to ensure that they do not contradict legislation or the Constitution is highlighted by this ruling. The UDM has previously warned against this sided approach.
